GYM DEFENDS ACTION IN T-SHIRT ROW



A newspaper cutting arrived in my post a few days ago from some South African friends. The story is below and is hilarious!

I am an Old-Edwardian, having gone to school at King Edward VII school in Johannesburg for 11 years, from 1933 to 1943.

It was a school rife with anti-semitism and I was at the school during the period when Hitler was trying to kill off the whole of the European Jewish community.

Here we have some zionists at Old-Eds doing the reverse because they support Israel's anti-apartheid activities as they try a different sor of genocide against the Palestinians.

As a Jew who is anti-zionist and disgusted with Israeli actions in Palestine, which they are stealing bit by bit from the Palestinians, I think the actions of South African zionists is as despicable as those of the zionists around the world, including the Jewish zionists and Christian zionists in all the western countries.

Johannesburg - Muhammed Desai, the co-ordinator of Boycott Divestment and Sanctions (BDS), “aggressively declined a polite request” to take off his BDS/ YCL branded T-shirt when asked to do so.

Instead, he said he would force his way into the gym if he weren’t allowed in, Virgin Active said on Thursday.

It was defending its decision to remove Desai from its gym for wearing the branded T-shirt.

Virgin Active faced a backlash from its members on Wednesday night when police removed Desai from its Old Eds branch, which has a large Jewish membership.

Desai is a member of the South African chapter of lobby group BDS, which seeks sanctions against Israel.

He has given the gym an ultimatum that if it does not affirm his right to wear the T-shirts, it will find itself before the Human Rights Commission and Equality Court.

Desai said he was meeting the management of Virgin Active on Thursday night.

He said he had a three-year Virgin Active membership and when attending gym, he would wear T-shirts of various organisations and campaigns.

However, on Wednesday morning, Desai received calls from the branch manager of Old Eds Virgin Active and the regional manager telling him they had received complaints from pro-Israeli supporters about his shirts.

“The managers said I would not be allowed to enter the gym as long as I wore a BDS T-shirt with pro-Palestinian messaging, or one calling for a boycott of Israel,” said Desai.

He requested copies of the complaints, but they were not provided. He also requested the relevant policies and a letter outlining the reasons for the decision. After not receiving a response, Desai went to the gym in the evening wearing his BDS/YCL Chris Hani T-shirt.

The T-shirt is emblazoned with the words: “From the coast of Cape Town to the coast of Gaza in solidarity with Palestinians against Israeli apartheid.”

“The manager informed me that he had been instructed to remove me. I offered to leave but only if relevant policies could be provided and a copy of a letter outlining why I would not be allowed in. The gym then called the police, but they refused to arrest me. Virgin Active then claimed they wanted me removed for my own safety.”

According to Desai, the police responded that if he was assaulted they would arrest those responsible.

In a video released on YouTube, it appears Desai deliberately wore the T-shirt after the warnings and had a camera on standby to record the incident.

In the video, he says the manager refused to give him, in writing, the rules stating that political or social justice T-shirts weren’t allowed, and called the police.

“I am a paid-up member and have the right to be here and to have access to the gym facilities. It is those with problems against human rights who are offended,” he said.

Virgin Active spokeswoman Les Aupiais said the goal was for its health clubs to be neutral spaces in which members could pursue their health and wellness goals while accommodating the rights and freedoms of all members.

The gym “wasn’t in the business of restricting speech or policing personal behaviour unless it contravenes the club rules, the law, or carries some kind of threat to the safety of staff and members”.

“In all instances we seek a negotiated solution to any perceived conflict. When he appeared at the club, clearly intent on making a political statement and generating confrontation, management was concerned about the potential consequences and called on the police to intervene. This is a situation we have never encountered before, and we’ve learnt valuable lessons.”

She said Virgin Active didn’t believe its clubs should be forums for contentious political activity.

“Mr Desai has not been banned and is welcome to return to train as a member as long as he respects the conditions of membership.

“We have sought an urgent personal meeting with Mr Desai to discuss our position. Any member who made provable threats on our premises of physical violence against Mr Desai, or any member on any occasion, will have their membership reviewed and possibly terminated,” Aupiais added.

I just got back from an astounding trip to South Africa where, among other things, I was privileged to meet Archbishop Desmond Tutu.  I also spent quite a bit of time with members of the nascent group South African Jewish Voices for a Just Peace in Cape Town and Johannesburg–really fabulous people. Lately, for instance, they read out the names of children killed in Gaza at an action at Constitution Hill, an iconic historical site that symbolizes the destruction of apartheid and the rule of law.
And readers of this site may remember this post on an article in the South African Jewish Report on September 10 by one Leon Reich (who is also head of something called Likud South Africa) that trashed the beloved Tutu, comparing him to Hitler in a vicious photo-cartoon and saying that the two men were similar in their desire “to kill Jews,” all because of Tutu’s criticisms of Israel.  The cartoon and article were pulled within hours from the SAJR website but they sent ripples of dismay throughout the world, especially in the South African Jewish community.
Members of Jewish Voices for a Just Peace seized on the case and are pressing for action against Reich. First they fired off a letter to the Cape Times, which ran as the lead letter under the title “Hateful likening of Desmond Tutu to Hitler does not speak for all Jewish people.” (Note that in South Africa the word “struggle” is capitalized. Spelling is in the British style.) Here it is, in full.

We South African Jewish Voices for a Just Peace (JVJP) refer to the op-ed article in the South African Jewish Report (SAJR) online dated September 10 in which chairperson of Likud SA and regular contributor to the SAJR, Leon Reich, compares Archbishop Emeritus Desmond Tutu to Hitler and Stalin and refers to Tutu as a “self-appointed midget.” Reich also refers to Tutu’s “anti-Semitism.”

Given Desmond Tutu’s history and character as a Struggle stalwart and one of the great and unwavering contemporary moral voices in this country and the world, as South African Jews we cannot emphasise enough how strongly we condemn the article and the position of its author.
We utterly reject the assumption that dissent from Zionism is equivalent to anti-Semitism.
We also take issue with the article’s distorted and dishonest representation of the Palestinian solidarity movement as a movement invested in the “destruction of Jews.” This is an age-old myth that is perpetrated by Zionist Jews to maintain a siege mentality among Jews in South Africa.
We are also offended by the tone of the so-called apology published by the editor of the SAJR online.
The apology is more concerned with the way in which the article may have offended some Jews with its reference to the Holocaust than it is with making amends to Tutu by offering a sincere and unequivocal apology as would be fitting under the circumstances. We note that the writer of the offending article, Leon Reich, has as yet not apologised.
The reason we speak out as Jews against this offensive article is that this attack on Tutu’s character was launched by a Jewish organization, speaks to a Jewish audience, and frequently invokes the collective “we” which assumes that the Jewish community is homogeneous in its views.
For this very reason, we feel it is important to state that we will not sit in silence while hateful utterances such as these are said in the name of all South African Jews.
As proud South African Jews, we reject the comparison of the Arch to Hitler.  This comparison is hate-speech, libellous and morally offensive.
We also reject the petulant apology and call on the SAJR to immediately issue a sincere statement unequivocally apologizing to Tutu for the verbal and visual comparison to Hitler.
Reich is writing in a South Africa where hate speech is unacceptable.  We are of the view that charges should be laid against Reich with the relevant South African authorities and that he should be prosecuted for libel.
South African Jewish Voices for a Just Peace (JVJP) are a group of South African Jews who reject the equating of the religion and culture of Judaism with the political project of Zionism.
We recognize that Palestinians live under a particularly brutal military occupation which is based on a violation of their rights.
We support the formation of a society based on equality and respect for human rights for all who live in Israel-Palestine.

JVJP insisted that Reich apologize within 24 hours or they would go to the authorities.  Reich refused, saying that everything he had said was “true.”
Not only did they write a letter to the newspaper, but JVJP made a formal complaint some days later to the South African Human Rights Commission charging libel, slander and hate speech against “the Arch,” as he is commonly called (even by himself).  The Commission responded last week, formally acknowledging receipt of the letter and stating that if the complaint was beyond their jurisdiction, they would send it on to authorities who could deal with it.
A member of JVJP told me yesterday that the Commission is “not a toothless tiger.” He is hopeful that some kind of action against Reich will result.

WITWATERSRAND UNIVERSITY VICE-CHANCELLOR JOINS THE ZIONISTS

An incident occurred at Wits University which caused the Vice-Chancellor to become involved.

The episode related to a visiting pianist from Israel and there was a protest by a group of people who support the Boycott, Divestment, Sanctions (BDS) movement supporting Palestine and against Israel and who were against the pianist being allowed to give a performance at the University.

Now before getting launched on the rights and wrongs of the issue, it needs to be stated that from the onset of the apartheid years in 1948, Wits University students were prominent in anti-aparthied actions and demonstrations and in support of the university being able to allow people to study who came from any and every "race" group in South Africa.

There were appalling actions by authorities, police and apartheid spies on campus who tried to stop protests and who were instrumental in getting students expelled and/or removed from campus and/or suspended.

The present incident has occurred post the apartheid years but events linger in the memory and are not easily forgotten.

The University of the Witwatersrand, Johannesburg, deeply regrets that a concert held on its campus last night was disrupted by some members of the University community and representatives of external organisations.

In light of this incident, the University takes this opportunity to issue a public apology to all those who attended the concert. The disruption of this event points to intolerance on the part of some members of the University community and goes against the core values espoused by the University. The University is investigating this matter and will take the necessary action based on its policies, processes and procedures.

The University reiterates that  the views and opinions expressed by the Students' Representative Council or any other student groups on campus do not represent the official views of the University, nor are they necessarily an accurate reflection of the views of the majority of students, staff and alumni.

Wits University is a leading institution on the African continent renowned for encouraging dialogue and debate on often diverse and conflicting views confronting society. It provides a platform for different constituencies to express their views and opinions through considered debate and intellectual engagement in the spirit of tolerance, respect and openness.

8 APRIL 2013: UPDATE ON ISSUES RELATING TO THE DISRUPTION OF A CONCERT ON THE WITS CAMPUS

On 12 March 2013 a University-sanctioned musical recital by pianist, Mr Yossi Reshef, was disrupted by a group of students and members of the public.

Understandably, the University has received many letters from members of the University community expressing concern at this incident. At the same time, it is clear from many of these messages that there are a number of matters that need to be clarified.

The University would therefore like to reiterate the following:

1. The University views the disruption of the concert in an extremely serious light and is addressing this violation of its Code of Conduct through a thorough, formal investigation and disciplinary process. The University requests that all parties allow the law to take its course.
2. Wits issued a public apology within 24 hours of the incident occurring. (This apology is published above this letter.)
3. A personal letter of apology was sent from both the Vice-Chancellor and Principal, and the Vice-Chancellor Designate, to Mr Yossi Reshef.
4. The Vice-Chancellor and Principal met with the South African Jewish Board of Deputies to discuss this matter.
5. The University reaffirms its unwavering commitment to academic freedom.

The University therefore believes that alarmist judgments and blame heaped upon Wits as an institution by some commentators and media reports is unwarranted and misguided. It is not fair or reasonable to seek to tarnish the hard-earned reputation of a venerable University because of the actions of a group of protesters.

Wits has a proud history and tradition of being a vibrant platform and space for diverse individuals and groups to engage with its multiplicity of stakeholders, in a convivial environment. It has always advocated for academic freedom and institutional autonomy and will continue to do so, as these are the foundation of knowledge and intellectual engagement in any great University.

We value the concerns and comments received on this matter and give the assurance that this matter will be dealt with appropriately. We reiterate that the University is ensuring that those responsible for perpetrating this act are held accountable and will be subject to its disciplinary procedures. This process is already underway and we will inform all stakeholders of the outcomes. We have also offered to host the concert again and to honour all the tickets that have previously been sold.

16 APRIL 2013: UPDATE ON THE INVESTIGATION INTO THE YOSSI RESHEF CONCERT

The University of the Witwatersrand can confirm that it has charged 11 members of the Wits community for a possible contravention of the University’s codes of conduct relating to the disruption of a concert that was hosted on the Wits campus on 12 March 2013.

External Senior Counsel  has been appointed in terms of the University’s Rules for Student Discipline to act in lieu of a Student Discipline Committee, to chair the hearing, and to carry out all of its functions and to exercise all its powers. As such, he or she will make a decision as to whether or not to publish details of the disciplinary proceedings.

Wits University announced on Friday, 17 January 2014 that a verdict had been reached in a case which saw 11 students charged for the disruption of a concert by musician Yossi Reshef on its campus last year.
Ten students have been found guilty of misconduct for disrupting or inciting others to disrupt the piano recital. They have been excluded from the University for a period of one year. The sentence is suspended provided that the students are not found guilty of any other form of misconduct for a period of two years. These students will not be allowed to hold any office in any student governance structure for a period of one year. In addition, they will each have to perform 80 hours of community service, as determined by the University.

The University of the Witwatersrand, Johannesburg, today announced that a verdict has been reached in a case which saw 11 students charged for the disruption of a concert by musician Yossi Reshef on its campus last year.

Ten students have been found guilty of misconduct for disrupting or inciting others to disrupt the piano recital. They have been excluded from the University for a period of one year. The sentence is suspended provided that the students are not found guilty of any other form of misconduct for a period of two years. These students will not be allowed to hold any office in any student governance structure for a period of one year. In addition, they will each have to perform 80 hours of community service, as determined by the University.

One of these students has further been found guilty of not obeying a lawful instruction issued by a University employee, and will be required to perform an additional 50 hours of community service for this offence.
The verdict was handed to the University by an independent advocate today, Friday, 17 January 2014. The Senior Counsel was appointed in terms of the University’s Rules for Student Discipline to act in lieu of a Student Discipline Committee, to chair the disciplinary hearing, to carry out all of its functions and to exercise all its powers in line with the University’s policies, procedures and processes.

SAJBD : Outcome of Wits Disciplinary Process

The verdict against ten students guilty of misconduct during a concert at Wits University represents a resounding reaffirmation by Wits of the values of academic freedom, diversity and tolerance. In March last year, a group of demonstrators lead by members of the then Student Representative Council invaded the venue where Israeli-born pianist Yossi Reshev was giving a recital and prevented the event from continuing.

 This behavior was immediately condemned by the University leadership and steps were duly implemented to investigate the incident and call to book those responsible. In addition to taking appropriate action against those who perpetrated the disruption of the Reshef recital, the University also hosted a follow-up concert by a group of internationally renowned Israeli jazz musicians headed by Daniel Zamir.

 This resoundingly successful event took place on 28 August in the Wits Great Hall, which was packed to capacity for the occasion. All necessary measures were taken by the University to ensure that the concert went ahead without incident, thereby affirming the University’s commitment to creating safe spaces for all on the campus. The SA Jewish Board of Deputies (SAJBD) applauds Wits University for taking a firm and unambiguous stand against those who abuse their right to protest by flouting the principles of academic freedom and unlawfully seeking to silence alternative viewpoints.

The outcome of the above hearings sends out a clear message that Wits remains committed to providing a free, open environment in which the values freedom of expression and association are strenuously upheld and where any behavior aimed at preventing others from exercising those rights is not tolerated. The SAJBD is hopeful that the satisfactory outcome to the Reshef affair will usher in a new era of mutual respect, trust and openness on Wits campus, one that provides safe spaces for the expression of diverse opinions and where people of differing viewpoints can learn from rather than try to silence one another.”

A protest against Israeli Independence Day at the Gold Reef City Casino in Johannesburg turned violent on Monday night after members of the South African Palestinian solidarity activist community were reportedly assaulted by the Jewish Community Security Organization (CSO). One activist suffered a concussion.

South African activists are pressing charges against the South African Jewish Community Security Organization (CSO), the South African Zionist Federation and the South African Jewish Board of Deputies (SAJBD) for the recent violent assault of two young women Palestine solidarity protesters (including the daughter of a senior member from South Africa's largest trade union federation, COSATU) . One Palestine solidarity protester was left in a state of concussion due to the assault injuries.

Last night supporters of Israel held a music concert to celebrate Israeli Independence Day at Gold Reef City Casino in Johannesburg, which was organized by the South African Zionist Federation (SAZF) and the South African Jewish Board of Deputies (SAJBD).

The South African Zionist Federation (SAZF) and the South African Jewish Board of Deputies (SAJBD) had insisted on arranging their own security (the "Jewish Community Security Organization") instead of allowing either Gold Reef City Casino or the South African Police Services (SAPS) to perform the role of safety and security for the Israeli event.

Palestinian protesters contested that the Israeli celebration was essentially a "celebration of murder, expulsion and continued Israeli oppression against the indigenous Palestinian people" and arranged a picket outside the venue where over 250 members from COSATU, the SA Students Congress, BDS South Africa and several other civil society organizations were present. In addition, young activists (mostly women students) had also bought tickets, made their way into the venue of the Israeli event and partook in a direct-action Greenpeace-like protest where they released bad smelling "stinky-bombs" and wore T-shirts that read "Israeli Apartheid Stinks" in luminous green writing.

During the direct-action protest inside Gold Reef City, two young women protesters were violently assaulted by the Jewish Community Security Organization (CSO) including having their hands tied with cables, their faces covered and their heads smashed into the parking lot's concrete paving. Other protesters were forcibly thrown down escalators and one protester was locked into a passageway where he was repeatedly and simultaneously kicked in the stomach by more than five Jewish Community Security Organization (CSO) personnel - he later suffered a concussion. Members of the Jewish community attending the event also punched a woman protester in the face several times resulting in a serious swelling injury.

Charges against the Jewish Community Security Organization (CSO), the SA Zionist Federation (SAZF) and the SA Jewish Board of Deputies (SAJBD) include:

- Smashing the heads of two young women protesters into the concrete paving of the Gold Reef City Casino parking lot;
- Illegally restraining the young protesters with cable ties and leaving them with their heads covered in the Gold Reef City parking lot;
- Locking a protester into a passage way, throwing him to the ground and then instructing over five security personnel to kick the protester, which resulted in a state of concussion;
- Throwing two young women protesters down escalators resulting in several body bruises, including a badly injured leg;
- Forcibly hurling several women protesters onto walls;
- Verbally abusing the young protesters, including threatening to "find them" and "kill them";
- In addition, a charge of theft will be laid against the Jewish CSO, the SAJBD and the SAZF for having illegally confiscated cellphones and other possessions from the protesters.

University of Johannesburg academic, Professor Farid Esack, who witnessed the violent assaults on protesters by the Jewish Community Security Organization (CSO), commented: "Its unacceptable that any local community security organization, including that of the the Jewish community (the Jewish Community Security Organization), operates above the law and in this militarized fashion.Given that the Jewish Community Security Organization was recently guilty of racial-profiling and discrimination at Wits University, they together with all Israeli-connected security entities operating in this country, should be banned from any and all future events. They are a threat to our people and I will personally be taking this up with relevant government departments."

The Jewish CSO, a mostly clandestine security body operating in South Africa since 1993, is led by former Israeli Defense Force (IDF) member, Colonel Amir Noy. Noy served for 14 years in the IDF before working as a project manager for the Zimbabwean government. Noy explains the role of the Jewish CSO as that of: “Protecting Jewish life and Jewish way of life [in South Africa]...[its] a bond of brotherhood".

Another high-profile witness to the violent assaults was Chris Mathlako, the International Relations Secretary of the South African Communist Party (a member of the ruling ANC tripartite alliance). Mathlako also slammed the Jewish Community Security Organization (CSO) and added that: "I was shocked at the way in which the Jewish Community Security Organization was behaving like a bunch of thugs, carrying large semi-automatic weapons, beating up young activists and threatening to kill them. The Jewish Community Security Organization is not above the law and should not think that they can get away with this sort of behaviour in our country. This is a serious indictment on the SA Jewish Board of Deputies and the South African Zionist Federation."

Uyanda Mabeche, one of the seriously injured protesters had this to say: "The SA Jewish Board of Deputies (SAJBD), SA Zionist Federation (SAZF) and their Jewish CSO must be held accountable for what they did to me and my fellow colleagues...its also a sad reflection of how Israel and its supporters deal with protests and criticism. However, I'm very deeply aware that what myself and my colleagues experienced - although very traumatic - is nothing in comparison to what Palestinians go through on a daily basis under the yoke of Israeli apartheid and occupation."
